That Resolution calls on the Government of Romania to provide prompt and fair restitution to the various religious communities of properties that had been confiscated by the former Communist regimes.

While respect for religious and property rights is indispensable for a democracy, progress in restoring religious properties to their rightful owners has been extremely slow. As a new member of NATO, Romania ought to be expected to live up to its commitments and thereby advance vital U.S. interests in a stable and democratic Central and Eastern Europe.

Being the co-chairs of the Hungarian American Caucus, I would also like to urge both of you to ask the members of the Caucus to support and cosponsor H. Res. 632.

Congressman Tom Lantos and I recently wrote to the Prime Minister of Slovakia and the President of Ukraine urging they settle the border concerns of an ethnically Hungarian village, Szelmenc, which is divided between two countries.

As the co-chair of the Hungarian American Caucus, I have been active on issues of concern to Hungarians. The Hungarian American Caucus provides a forum for the voices of 1.5 million Hungarian-Americans to be heard in Congress.

RESOLUTION
Urging the Government of Romania to provide equitable, prompt, and fair restitution to the Romanian Greek Catholic Church, the Roman Catholic Church, the Evangelical Lutheran Church, the Unitarian Church, the Hungarian Reformed Church, the Jewish community, and other affected religious communities for property confiscated by the former Communist government in Romania.

Whereas the Romanian Greek Catholic Church, the Roman Catholic Church, the Evangelical Lutheran Church, the Unitarian Church, the Hungarian Reformed Church, the Jewish community, and other affected religious communities have suffered the confiscation of their property in Romania;

Whereas on December 1, 1948, the Communist government in Romania enacted legislation which dissolved the Romanian Greek Catholic Church and transferred most of its property to the Romanian Orthodox Church;

Whereas many Romanian Greek Catholic churches, Roman Catholic churches, Evangelical Lutheran churches, Unitarian churches, Hungarian Reformed churches, and Jewish institutions were closed by the Communist government and many of their secular properties seized;

Whereas a central element of persecution by the Communist government in Romania was the uncompensated confiscation of real and personal property from individuals and religious communities;

Whereas on January 2, 1990, the 1948 decree which dissolved the Romanian Greek Catholic Church was abrogated, Greek Catholics began to worship openly again and three secretly ordained bishops emerged from hiding;

Whereas the Romanian Government adopted Law-Decree NR. 126/1990 to lay down legal provisions and procedure for the return of confiscated property that originally belonged to the Greek Catholic Church;

Whereas to date, religious communities have reportedly received less than five percent of their former properties;

Whereas on June 1, 2002, Pope John Paul II urged Romania to return all assets of the Romanian Greek Catholic and Roman Catholic Churches that were confiscated by the Communist government;

Whereas on June 3, 2002, Romanian President Ion Iliescu refused to actively pursue the restitution of Catholic Church property, stating “the state cannot interfere in restituting churches to the Catholic Church”;

Whereas the affected religious communities deserve the return of or compensation for property seized by the Communists;

Whereas since 1990, post-Communist countries in Central and Eastern Europe have grappled with the question of how to redress these wrongful confiscations of property with Romania lagging significantly behind the others; and

Whereas the Chairman of the United States Commission on Security and Cooperation in Europe observed that hundreds of court decisions in favor of property claimants were reversed by the Romanian supreme court after they had become final and irrevocable judgments, actions which the European Court of Human Rights has ruled violated the European Convention on Human Rights: Now, therefore, be it

Resolved, That the House of Representatives—

(1) notes with concern the apparent unwillingness of the Government of Romania to provide equitable, prompt, and fair restitution to the affected religious communities for property confiscated by the former Communist government in Romania; and

(2) calls on the Government of Romania to:

(A) provide fair, prompt, and equitable restitution to the affected religious communities under Romanian law and in accordance with the Constitution of Romania and all applicable international agreements to which Romania is a party;

(B) respect the constitutional rights of existence and practice of the affected religious communities, and fully enforce all court decisions regarding the restitution of or access to seized properties;

(C) stop the demolition and dismemberment of Greek Catholic churches and immediately ensure the security of all Greek Catholic churches and other buildings from the 18th and 19th centuries;

(D) provide restitution for the property rights of all agricultural and forestry lands belonging to the affected religious communities;

(E) repeal Law-Decree NR. 126/1990, and allow claims to be heard by an independent, unbiased, nonreligious commission; and

(F) ensure that the special commission instituted under Law 501/2002 considers the thousands of applications for restitution in an open, transparent, and prompt manner, and expeditiously issues decisions on the return of properties to religious communities.

Frissítés: a javaslat újra beadva a 109. Kongresszusban — H. Res. 191

A H. Res. 632 nem került megszavazásra a 108. Kongresszus lezárultával, ezért Lantos Tamás és Tancredo képviselők 2005. április 6-án újra benyújtották ugyanazt a kezdeményezést H. Res. 191 néven — szövege lényegében azonos a korábbival: a romániai kommunista rendszer által elkobzott egyházi ingatlanok (a görögkatolikus, római katolikus, evangélikus-lutheránus, unitárius és református egyházak, valamint a zsidó közösség tulajdonának) gyors és méltányos visszaszolgáltatását sürgeti Romániától. Lipták Béla arra kérte a Lobbi tagjait, hogy most is írjanak saját képviselőjüknek a szponzorálás támogatásáért — a levél lehet egyetlen mondat is (“Please co-sponsor HR 191”), a lényeg, hogy mindenki írjon, és barátait is erre kérje.

Christopher Shays képviselő áprilisi válaszlevelében megerősítette, hogy az elmúlt hónapokban a vajdasági erőszakhullám miatt is levelet írt Vojiszlav Kosztunyica szerb miniszterelnöknek és Michael Polt szerbiai-montenegrói amerikai nagykövetnek, a magyar közösség és tulajdonuk biztonsága érdekében. Lipták válaszában megköszönte ezt, majd beszámolt a Budapesten tervezett két 1956-os emlékműről: az egyik a Gellért-hegyi, szovjet eredetű “felszabadulási emlékmű” átalakítása lenne — a szoboralak kezében lévő pálmaágat a kommunista címerétől megfosztott, lyukas 1956-os zászló szimbólumára cserélve —, a másik pedig Reagan elnök emlékét örökítené meg, elismerve szerepét a szovjet birodalom megdöntésében. A tervek szerint mindkét emlékművet 2006. október 23-án avatnák fel, s a Lobbi fontolgatja, hogy erre az alkalomra Bush elnököt is meghívják.

Frissítés: győztünk, mert összefogtunk — a Képviselőház elfogadta a H. Res. 191-et

2005. május 23-án az amerikai Képviselőház egyhangúlag, kétharmados többséggel elfogadta a H. Res. 191-et, amely sürgeti a román kormányt a kommunizmus alatt elkobzott egyházi ingatlanok gyors és méltányos visszaszolgáltatására. A javaslatot Tom Lantos és Tom Tancredo terjesztette elő, tizenkilenc további képviselő társszponzorálásával; a szavazást az amerikai külügyminisztérium és a nemzetbiztonsági tanács illetékesei is támogatták, ami — tekintve Bukarest hagyományosan eredményes washingtoni lobbitevékenységét — nem volt magától értetődő.

Lipták Béla összegzése szerint az út 2003-ban kezdődött, amikor Megyesy Jenő felkereste Tom Tancredo colorádói képviselőt, aki még abban az évben Budapesten találkozott Tőkés László püspökkel, majd 2004-ben benyújtotta a H. Res. 632-t — az akkor még nem került napirendre. A 2005-ös sikert Lipták szerint a Tancredo–Lantos összefogásnak, s mögötte a demokrata (HAC-HHRF) és republikánus (AMSZ-HACC) beállítottságú magyar szervezetek összefogásának, illetve a több száz HL-levélnek köszönhetjük — hozzátéve a tanulságot: “nem jó vért szül, ha valaki megpróbálja kisajátítani az együtt kiharcolt eredményeinket.”

A Washingtoni Amerikai Magyar Koalíció elnöke, Maximilian Teleki szerint a határozat jelképes erejű, s az igazi nyomásgyakorlást inkább Brüsszeltől lehet várni — az Európai Parlament magyar képviselői most jó muníciót kapnak a romániai egyházi restitúció napirendre tűzéséhez. Nagy Sándor (HACC) az amerikai magyar szervezetek nagy sikerének nevezte az eredményt, amely megmutatta a Képviselőház kétpárti, magyar ügyek iránt érdeklődő csoportjának erejét; a téma napirenden tartásában nagy szerepet játszott a tizenöt éve a romániai egyházi javak sorsát követő New York-i Magyar Emberi Jogok Alapítvány is. Markó Béla, Románia miniszterelnök-helyettese ezzel egy időben arról számolt be, hogy a román szenátus júliusig fogadhatja el a húsz romániai etnikumot nemzeti kisebbségként elismerő kisebbségi törvényt.

Frissítés: olvasói javaslat a kivégzettek emlékművére

Sztáray Zoltán levelében azt javasolta, hogy a forradalom évfordulójára a megtorlás során kivégzettek nevét az emlékmű talapzatára vésve állítsanak nekik méltó emléket — az aradi 13 vértanú emlékművének mintájára, amely önmagában is beszél a nevek felsorolásával. Egy másik hozzászóló egyetértett azzal, hogy a Gellért-hegyi emlékmű váljon az igazi szabadság, 1956 jelképévé — hiszen a lyukas zászló a magyar nemzet saját “találmánya”, amelyet a világtörténelemnek adott —, és emlékeztetett rá, hogy Kovács Klaudia “Torn from the Flag” című, elsősorban külföldi magyar adományokból készülő dokumentumfilmje is ezt a jelképet fogja tudatosítani a világ számára, bár idehaza még semmilyen támogatást nem kapott.

Christopher Shays 2005. július 22-i levelében megerősítette, hogy 2005. május 23-án, a szavazáskor támogatta a H. Res. 191-et, amely azt fejezi ki, hogy a Kongresszus aggódik amiatt, hogy Románia korábbi kormányai elmulasztották a kommunista rendszer által elkobzott egyházi vagyon méltányos, gyors és igazságos visszaszolgáltatását — különösen a görögkatolikus, a zsidó és a magyar kisebbségi vallási közösségek esetében, ahol a visszaszolgáltatás a leglassabb és legkevésbé kielégítő volt. Mellékelte Michael Polt, szerbiai-montenegrói amerikai nagykövet válaszát is Lipták korábbi, a vajdasági autonómiáról és kettős állampolgárságról szóló megkereséseire.

Polt nagykövet levele szerint Milošević 1989-es alkotmánymódosításai csaknem megszüntették Vajdaság és Koszovó autonómiáját; a Milošević-et megbuktató demokratikus kormány 2002-ben korlátozott jogköröket adott vissza Vajdaságnak, amelynek ma nincs önálló bírósága, gyűlése csak törvényjavaslatokat terjeszthet a szerb parlament elé, végrehajtó tanácsának pedig nincs saját rendőrsége vagy belügyi/igazságügyi minisztériuma — a vajdasági kormánykoalíció pártjai bővebb autonómiát szorgalmaznak, Borisz Tadics pártja pedig egy teljes törvényhozási és végrehajtási autonómiát biztosító keretdokumentumot javasolt. A kettős állampolgárság kérdésében Polt szerint Szerbia általában engedélyezi a kettős állampolgárságot, ez nem akadálya annak, hogy a szerbiai magyarok magyar állampolgárságot is szerezzenek — Lipták feltehetően a Magyarország által tervezett, a teljes diaszpórára kiterjedő állampolgársági javaslatra gondolt, amelyet az EU rossz szemmel nézett, és amely a 2004-es népszavazáson elbukott; a vajdasági horvátok helyzete pedig csak azokra vonatkozik, akiknek közvetlenebb kötődésük van Horvátországhoz (pl. ott születtek). Az etnikai incidensek szintjét jelenleg alacsonynak, de a feszültségeket megoldatlannak nevezte, és üdvözölte a különböző etnikumú fiatalokat összehozó új vajdasági kezdeményezéseket.
